Ranchi: Jharkhand High Court has said in one of its orders that if a woman falls in the reserved category in Bihar or any other state, but she is married in Jharkhand, then she will not get the benefit of reservation.
The court has also made it clear in its order that a person will get the benefit of reservation in the state in which he is born. Actually, in the year 2016, JSSC had issued an advertisement for the appointment of teachers.
Reena Rana also participated in this appointment process. After being successful in the mains examination, the candidate was called for interview and certificate verification. Where she had claimed reservation on the basis of her husband’s caste certificate. But JSSC refused to give the benefit of reservation to Reena Rana. After which she filed a petition in the High Court demanding reservation.
After hearing all the parties, the court of Justice Rajesh Shankar while giving its verdict rejected Reena Rana’s petition. Advocate Abhishek Srivastava argued on behalf of applicant Reena Kumari Rana. Advocate Shweta Shukla presented her side on behalf of the state government. While advocate Sanjoy Piparwal argued on behalf of JSSC.
