Modi surname case, big relief to Rahul Gandhi from Jharkhand HC, exemption from physical appearance

Ranchi:  A hearing was held in the High Court on Wednesday on the petition challenging the order of the Ranchi MP-MLA court to make physical presence of Congress national leader Rahul Gandhi.

Accepting Rahul Gandhi’s petition, the court of Judge Justice Sanjay Kumar Dwivedi has exempted him from physically appearing in the lower court.

Rahul Gandhi has got a big relief from this order of the High Court.

Now he will not have to physically attend the Ranchi Civil Court.

On behalf of Rahul Gandhi, High Court advocates Piyush Chitresh and Dipankar Roy kept their side.

A person named Pradeep Modi, a resident of Ranchi, had filed a defamation case against Rahul Gandhi for commenting on the Modi surname.

On which hearing is going on in Ranchi MP-MLA court.

Rahul Gandhi had sought exemption from physical examination under section 205 of the CrPC (Code of Criminal Procedure).

During the campaign for the Lok Sabha elections 2019, Rahul Gandhi had said in the Congress meeting at Morhabadi Maidan in Ranchi, along with taking the names of Narendra Modi, Nirav Modi, Lalit Modi, those who have Modi in front of their names, they are all thieves.

On this alleged objectionable remark, advocate Pradeep Modi has filed a complaint in the Ranchi Civil Court.

In the complaint number (1993/19) it has been said that calling all Modi thieves is condemnable, painful and heart-wrenching.

The complainant has also filed a defamation case of Rs 20 crore against Rahul Gandhi.
