The court said that when their appointment is right then they are entitled to equal rights with all so they should be regularized from the year 2014 whereas RIMS has regularized him from the year 2018. Apart from this, the court has also directed them to give the benefit of PF and gratuity from the year 2003. The court of Justice Dr SN Pathak of the High Court had reserved its decision after hearing both sides. After this, the order of the court has been uploaded on the website. The court, in its order, has said- “They have been appointed in the year 2003 after fulfilling all the criteria. Their case comes under the order passed in the case of Uma Devi. Therefore, they cannot be seen in a different way. They have the right to get facilities like other staff nurses, so they should be regularized from the year 2014.

RIMS had not regularized six staff nurses citing age. Against this, Lily Kujur and others had filed a petition in the High Court. In the year 2003, these people were appointed on a contract basis in RIMS on the post of Staff Nurse. But after making new rules in the year 2014, RIMS issued advertisements for a permanent appointment. These people applied for this appointment, but RIMS did not regularize six people citing age but regularized all the others along with them.
