Ranchi: Jharkhand High Court, while hearing a case, has expressed concern over the misuse of IPC section 498A (cruelty inflicted on a woman by her husband or in-laws).
The court has said in its order that wives dissatisfied with their in-laws are misusing this provision of the law as a weapon.
The court of High Court judge Justice Sanjay Kumar Dwivedi said that such cases are being filed by the wife out of anger over a minor dispute without proper consultation.
The court said these things during the hearing of the petition filed by a woman to cancel the FIR lodged against her brother-in-law and sister-in-law.
A woman resident of Dhanbad had filed an FIR against her in-laws alleging torture.
To cancel this, Rakesh Rajput and his wife Reena Rajput had filed a petition in the High Court.
Advocate Ashma Khanum, appearing on behalf of the accused, told the court during her arguments that all the allegations levelled against them are false.
Because he was traveling by train on the day of the alleged incident.
After hearing the arguments, the court quashed the entire criminal proceedings including the cognizance order taken by the Dhanbad Civil Court against Rakesh Rajput and his wife.
